GENERAL TERMS AND CONDITIONS


These conditions exclusively govern the sale of all services and products sold by BoisFer.
These products are sold new, unless otherwise specified in the quotation.


Article 1: Acceptance of the General Terms and Conditions of Sale

The customer declares that he has read and accepted these general conditions of sale. Payment of the deposit implies acceptance of these General Terms and Conditions of Sale. In the absence of proof to the contrary, the data recorded by BoisFer constitutes proof of all transactions between BoisFer and the customer.


Article 2: Order
The customer is solely responsible for completing the online order form, specifying the references of the products chosen and their quantity. The customer will also specify his name and delivery address.
In the event of a data entry error, BoisFer cannot be held responsible for the consequences in terms of delay or impossibility of delivery. All costs relating to the reshipment of products due to an error in the customer's data entry will be borne exclusively by the customer.
The customer may check the details of his order and the total price before sending it to BoisFer. The customer may modify or cancel the order before it is sent to BoisFer.
BoisFer will acknowledge receipt of the order by sending the customer an e-mail to the address shown on the order form.
The sale is considered valid when the price has been paid.
BoisFer reserves the right to refuse an order if a payment dispute is in progress with the customer.


Article 3: Availability

The offers proposed on the site must be ordered from our supplier. In the event of non-availability of the products selected by the customer, replacement products may be proposed by e-mail and, if necessary, a refund of the product ordered will be made to the customer's account.


Article 4: Products

The Customer is hereby informed that there may be slight differences between the photos of the products shown on the Site and the products themselves (colour rendering by software, wood grain, knots, antique manual finishes, handcrafted manufacture, recycled wood or antique metal, unique pieces, etc.).


Article 5: Prices

The prices of our products are shown on the Site in euros, inclusive of all taxes. Prices do not include shipping and handling costs (see Article 6: Delivery times and costs). The customer is informed of the order processing and delivery costs directly when validating their basket.


Article 6: Delivery and lead times
Delivery conditions are detailed in the 'Delivery methods' section.
Products purchased on the Site are delivered in Belgium. Delivery costs are indicated to the Customer before the order is definitively registered.
In the event of specific delivery conditions, the Customer must IMPERATIVELY inform BoisFer of any information relating to access BY TRUCK to the place of delivery (difficult access, narrow, rocky, on a slope, at altitude, island or peninsula, pedestrian street, access closed to traffic) by using the 'comments' box just before validating the order. Without acceptance and without prior information, parcels will be delivered to the carrier's platform closest to the customer's home. The customer will have to collect them on site.
In the event of a delivery error due to the customer incorrectly entering the address when placing the order, the customer will be invoiced for and responsible for any re-shipment of the order.
In the event of delivery being refused because the item is not suitable for the customer, the returns charge (see Article 9 - Returns) will be applied and deducted from the refund once the order has been received.


Article 7: Checking parcels on delivery
The customer must carefully check for any damage upon delivery of the product. In the event of damage (for example: package intact but article damaged, package damaged, already opened, package missing, such article damaged in such place...), the customer must refuse the product or accept it with written, precise and motivated reserves. The customer is hereby informed that any reservations must be made immediately to the delivery person and must be specified directly on the delivery note. Any general reservation such as 'subject to unpacking, packaging intact' has no value. The reservations must be detailed and describe the damage(s) suffered by the product. The customer is hereby informed that the absence of any written reservations on the delivery note constitutes delivery of the correct product. Any reservations must be confirmed by registered letter with acknowledgement of receipt within 3 days. Please send us all photos (packaging + product) by return e-mail. If you do not do this, you accept de facto, by the transfer of ownership (acceptance of the package without reservation), responsibility for apparent defects such as shocks, breakages, scratches.
If, for any reason whatsoever, the customer has not been able to express sufficiently precise written reservations and wishes to provide further details, he must send a registered letter with acknowledgement of receipt to the BoisFer head office, within 24 hours. In order to ensure better follow-up, the customer may also send a copy of this registered letter to info@boisfer.be.
If the delivery person refuses to make any reservations or to check the packages, he will be expressly requested to write on the delivery note 'the driver refused to check the packages'.
To obtain repair, replacement or reimbursement of the product, the customer must comply with the procedure described above.
Any refusal of delivery, for an appointment not confirmed or cancelled after dispatch, for an absence during the confirmed appointment, for any article refused without damage, or not unpacked, is considered as a withdrawal. The return fee, the conditions of which are set out in chapter 9- RETRACTION, will be deducted from the refund once the product has been returned to BoisFer or its supplier.


Article 8: Payment
Payment for a product on the Site is made by bancontact.
The order will not go into production until the bank transfer has been received.


Article 9: Withdrawal and returns
In accordance with the legal provisions in force, the customer has a period of 14 days to exercise his right of withdrawal without having to justify the reason or pay any penalty, with the exception, where applicable, of the cost of returning the product once it has been dispatched.
In accordance with the regulations in force, the customer will be reimbursed by the same method of payment used to register the contract, within 14 days of notification of the use of the right of withdrawal.
It is understood that all customary precautions must be taken to ensure that the returned goods are transported in good condition so that they can be marketed. The consumer must ensure that the goods are properly packaged and take all precautions for the return journey. The organisation of the return of the goods is the responsibility of the customer and must be carried out within 14 clear days from the date of delivery to the address communicated to the customer by e-mail.
The return transport of the product is the responsibility of the customer. In all cases, there is no obligation to return items in their original packaging. However, each item returned must be packaged in such a way as to ensure that it can be returned in equivalent conditions of safety.
Goods made to the consumer's specifications, known as personalised or made-to-measure goods, are excluded from the scope of application.


Article 10: Intellectual property
All texts, comments, works, illustrations, works and images reproduced or represented on the Site are strictly reserved by BoisFer under copyright as well as intellectual property and for the whole world. Any total or partial reproduction or representation of the Site or of all or part of the elements found on the www.boisfer.be site is strictly prohibited.


Article 11: Other services
Any other service offered by BoisFer will be accompanied by an official document setting out the General Terms and Conditions of Sale applicable to it (invoice, estimate, quotation). In any event, the customer will have the opportunity to read them before making any commitment.
